Terms and Conditions

This website is owned and operated by George Bateman & Son Limited (“Batemans”). By placing an order on the Batemans shop website you, the “Purchaser”, confirm your agreement to the Terms and Conditions below.

The Purchaser must be over 18 years. Deliveries can only be made to an address in the Mainland United Kingdom.

All products are offered subject to availability. The Purchaser will be notified by e-mail or telephone of receipt of the order generally within 24 hours of a working day of the order being placed. A contract for the purchase of any product will not be completed until Batemans notify the Purchaser of the order’s acceptance. Batemans are entitled to refuse any order placed by a Purchaser.

Batemans reserve the right to change the price of any product available on the website at any time.

The Purchaser undertakes that all details provided by it in relation to the purchase of goods are correct. The Purchaser further undertakes that funds are available to meet the cost of the product and any credit card used belongs to the Purchaser. Payment in full must be made prior to dispatch of the order by debit card or credit card (MasterCard and Visa). In the event of non-authorisation of payment Batemans will notify the Purchaser.

Delivery of products will be within 14 days of the order being accepted (subject to any events out of Batemans control). The Purchaser will be notified of delivery arrangements. A signature may be required on delivery. Every effort will be made to deliver on time, but Batemans shall not be held responsible for delays in shipment or late delivery or for additional charges for re-delivery in the event that delivery is unable to be made at the delivery address.

If the Purchaser is not satisfied with the goods they must be returned to Batemans within 21 working days for a refund. Returned goods must be accompanied by a receipt or other proof of purchase and must be in unused condition. While every effort will be taken to deliver the goods safely, some breakage may occur. In this event damaged goods must be returned to Batemans and will be replaced or refund will be given.

All goods must be returned by recorded delivery. Batemans will not accept responsibility for goods lost or damaged during their return, or costs incurred when returning goods.

Batemans endeavours to ensure that the website is protected and secure. On a secure website, there is an icon like a padlock at the bottom of the browser. However, because of the nature of the internet, Batemans does not give any warranties in respect of the availability, accuracy, completeness or performance of the website.

All material on the website belongs to Batemans and its licensors.

Batemans will not be liable for any consequential loss or damage or for any loss of data, profit, revenue or business, however caused. Without limiting this, Batemans’ liability to a Purchaser under these Terms and Conditions shall not exceed the greater of (a) £250 or (b) an amount equal to the sums payable by the Purchaser for products ordered from the website. Nothing in these Terms and Conditions shall limit Batemans’ liability for death or personal injury resulting from its negligence.

Batemans reserves the right to change these Terms and Conditions from time to time by posting the changes on the website. Orders submitted after such change will be subject to the revised Agreement.

These Terms and Conditions shall be governed by, and construed in accordance with, English law. The parties irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise in connection with these Terms and Conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
